TERMS AND CONDITIONS OF MEMBERSHIP AND MEMBER SALES
MEMBERSHIP. As a condition for his/her acceptance as a Member of the FOODSERVICE PURCHASING GROUP (FPG), each Applicant understands and agrees that he/she must continually abide by all the Terms and Conditions of Membership and Member Sales as defined herein, or as subsequently provided to Member by FPG in writing, as long as he/she remains an active FPG Member.
FPG PRICING ASSURANCES. FPG assures FPG Members that FPG published prices are below other dealer/distributor published prices on equivalent equipment or supply items. FPG Membersdiscovering otherwise are requested to advise FPG immediately.
MINIMUM ORDER AMOUNT. The FPG Minimum Order Amount is $100.00 (net of taxes and freight).
PAYMENT TERMS. Orders are accepted on a Prepaid Basis ONLY. FPG accepts VISA, MasterCard, and Discover credit or debit cards, Bank Checks, Money Orders and Company Checks (for company checks over $5,000.00, allow up to 15 additional business days for shipment to allow time for check clearing processes). FPG Member orders paid for by Bank Check, Money Order or Company Check qualify for the FPG Instant Rebate Savings Program, which provides our Members an immediate three-percent (3%) discount on their purchase. All published equipment and supply item prices include both the FPG Member Price and the Instant Rebate Savings Price.
DELIVERY TIMES. Generally, all in-stock equipment items are available for immediate shipment and delivery within 5 to 7 business days. FPG provides Members delivery quotes on all special orders, out-of-stock equipment and fabricated items. FPG will always do everything possible to meet required delivery dates.
FREIGHT TERMS. All equipment orders are shipped via the lowest cost routing F.O.B. Shipping Point and Tailgate Delivery to your delivery door. Unloading and installation of equipment is the sole responsibility of the Member. Lift-Gate Delivery Service to your delivery door available (at an additional charge) upon request.
At the time shipment is received please check freight bill to determine the number of packages shipped by FPG. Notate any shortages on the freight bill prior to signing for the delivery. Should it not be convenient or possible to unpack shipment at time of delivery, inspect the shipment packaging for any apparent damage. In either case, if any damage or shortage is found, advise delivery driver to immediately call the carrier to request an inspection report. Follow up such request in writing to the carrier. If no apparent damage is found on unpacked shipments, clearly indicate not inspected for concealed damage on the freight bill prior to signing for the delivery. Please remember, any damage or shortage must be reported and inspection requested within five (5) days. FPG CUSTOMIZED DELIVERY SERVICE. Customized Delivery Services, including delivery, uncrating, equipment assembly, setting equipment in-place, removal of crating materials (and replaced equipment items), is available to FPG Members at an additional cost. FPG Members requesting such services are quoted a firm delivery time and price prior to shipment. NOTE: FPG does not install equipment.
RETURN POLICY. Please do not return damaged items to FPG. No returns are accepted without prior written approval from FPG. Unauthorized Returns are not permitted. Authorized Returns made that are not the result of an error on the part of FPG must be shipped prepaid and are subject to a 25% restocking charge. All Authorized Returns must be shipped in accordance with written shipping instructions issued by FPG.
REFUND POLICY. In those rare cases where a refund may be the only remedial course of action warranted, FPG processes written refund requests from Members within 10-business days of its receipt of such requests.
WARRANTY. The FOODSERVICE PURCHASING GROUP hereby represents and warrants that any and all items purchased from FPG are As Ordered, New Manufacturer Equipment Items. All equipment is shipped (as ordered) with factory installation manuals and/or operating manuals together with the manufacturers warranty. FPG shall not be liable for any loss, damage or injury of any nature, whether direct, indirect, incidental or consequential, in connection with or resulting from the delivery, receipt or operation of equipment purchased from FPG and/or Bay Equipment & Supply, Inc. Any representation from any source whatsoever to the contrary is invalid.
